Requirements for Workers’ Compensation Eligibility

Injured workers may be eligible for workers’ compensation, so long as these basic requirements are met and it is important to note that the injured worker’s length of employment is not important.

1. Worker must be an eligible employee. Whether the employee is full-time, part-time, or a seasonal employee, they are typically eligible for workers’ compensation.

There are however, some workers that are not eligible for workers’ compensation.

A few examples include independent contractors and some domestic workers, both are not eligible for workers’ compensation benefits.

2. Employer must have workers’ compensation insurance coverage. Employers in Texas are not required to provide workers with workers’ compensation insurance coverage.

All employees are covered under a workers’ compensation insurance policy, if the employer does provide workers’ compensation benefits, plus the employer must let their employees know that they are covered.

3. Injury or illness must be work-related. The injury or sickness suffered by the injured worker had to have occurred while the worker was on the clock and performing job related activities.

The injured employee’s injury or illness does not, however, have to be on the work premises in order for the injured employee to receive workers’ compensation.

4. Filing a claim within the statute of limitations. In order for the injured worker to receive workers’ compensation, they must file a claim before the time period, or statute of limitations is up, or they will not be eligible.

Texas statute of limitations are defined as being one year after the injury has occurred, or one year after an illness has taken place due to a work-related cause.
